1. Data controller
The controller of the personal data collected through this website is Octopharma S.r.l., registered office at Via Giuseppe Pagano 2/c, 80078 Pozzuoli (NA), VAT and tax code 10646571215, REA NA-1121635, email info@octopharma.it, certified email (PEC) octopharma@pec.it.
For any request about your data you can write to the addresses above. No Data Protection Officer (DPO) has been appointed, as the cases in which appointment is mandatory do not apply.
2. Which data we process
Data you provide voluntarily through the contact form:
- first and last name;
- email address;
- the subject chosen from the list;
- the text of your message, including any personal data you choose to write.
Technical browsing data: like any website, the server hosting it automatically records some technical information (for example IP address, date and time, requested pages). We do not use this data to identify or profile you.
To limit repeated sending of messages (spam), the form temporarily keeps a technical identifier derived from the IP address (not readable in plain text), for a few seconds.
3. Why we process it and the legal basis
- Replying to requests sent through the form: the legal basis is your consent (Art. 6(1)(a) GDPR), given by ticking the box before sending, and the performance of pre-contractual measures taken at your request (Art. 6(1)(b)).
- Ensuring the security of the site and preventing abuse and automated submissions: the controller's legitimate interest (Art. 6(1)(f)).
- Complying with legal obligations or defending a right in court, if necessary.
Providing the form data is optional, but without it we cannot reply to your request.
4. Who receives the data
The form data is delivered to the controller's mailbox and is accessible only to authorised Octopharma staff.
To run the site we use Aruba S.p.A., which provides hosting, email service and domain management and is appointed as data processor. Data is not sold, disclosed or transferred to third parties for commercial purposes.
No transfer of data outside the European Economic Area is planned.
5. How long we keep it
- Messages sent through the form: 12 months from the last contact. If the request leads to a business relationship, the data needed is kept for the periods required by law.
- Technical server data: for the time strictly necessary for security purposes, according to the hosting provider's settings.
After these periods data is deleted or anonymised.
6. Your rights
You may at any time ask for:
- access to your data and a copy;
- rectification of inaccurate data;
- erasure of data;
- restriction of processing;
- portability of the data you provided;
- objection to processing based on legitimate interest;
- withdrawal of consent, without affecting processing already carried out.
To exercise your rights write to info@octopharma.it (or to the PEC address octopharma@pec.it). We normally reply within one month.
You also have the right to lodge a complaint with the Italian data protection authority, the Garante per la protezione dei dati personali (www.garanteprivacy.it).
7. Minors and other information
The site is not aimed at children under 14 and does not knowingly collect their data.
No profiling and no decision based solely on automated processing takes place.
The site may contain links to third-party websites (for example, in future, to sales pages on marketplaces). We have no control over those sites and their own notices apply.
8. Changes
This notice may be updated, for example if the services used by the site change. The date of the last revision is shown at the top of the page.
